Terms of Service

1. Acceptance of Terms

By accessing or using RefriComply ("the Service"), operated by Cutting Edge Development S.A.R.L. ("the Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these terms.

2. Description of Service

RefriComply provides refrigerant tracking, leak rate calculation, compliance monitoring, and reporting software for HVAC contractors. The Service includes a web dashboard, mobile application, and PWA quick entry system designed to help users comply with EPA regulations including the AIM Act (40 CFR Part 84).

3. Accounts and Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep it updated.

4. Subscription and Billing

• The Service is offered on a subscription basis with monthly or annual billing cycles
• All plans include a 14-day free trial with no credit card required
• Prices are listed on our pricing page and are subject to change with 30 days' notice
• Subscriptions automatically renew unless cancelled before the renewal date
• You may upgrade, downgrade, or cancel your plan at any time from your dashboard
• Payment processing is handled by Paddle.com (our Merchant of Record)

5. Refund Policy

If you are not satisfied with RefriComply for any reason, you may request a full refund within 14 days of your purchase date. To request a refund, contact us at support@refricomply.com.

• Refunds are processed within 5–10 business days
• The refund will be credited to your original payment method
• This policy applies to all subscription plans (Solo, Pro, and Business)

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious code, viruses, or harmful content
• Resell or redistribute the Service without written permission
• Enter intentionally false or misleading compliance data

7. Your Data

You retain ownership of all data you enter into the Service. You grant RefriComply a limited license to use, process, and store your data solely to provide and improve the Service. We will not access your data except as necessary to provide the Service, respond to support requests, or as required by law. You may export or delete your data at any time.

8. Compliance Disclaimer

RefriComply is a tool designed to assist with refrigerant tracking and compliance reporting. While we strive for accuracy, the Service does not constitute legal advice and does not guarantee EPA compliance. You are solely responsible for ensuring your business complies with all applicable federal, state, and local regulations. We recommend consulting with a qualified environmental compliance professional for specific regulatory guidance.

9. Limitation of Liability

To the maximum extent permitted by law, RefriComply shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for temporary unavailability due to maintenance, updates, or circumstances beyond our reasonable control.

11. Termination

Either party may terminate the agreement at any time. You may cancel your account through the dashboard or by contacting support. We may suspend or terminate your account if you violate these terms. Upon termination, you will have 30 days to export your data before it is permanently deleted.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved through binding arbitration.
